Dave Knotts is a partner in the firm’s Litigation, Insurance law and Alternative Dispute Resolution practice groups. His Amusement and Leisure clients have included resorts, festivals, athletic clubs, hotels, boating operations, a trampoline park, an amusement park, water parks, concerts, a sound production company, and ski areas. His practice generally includes insurance defense, personal injury, construction defect, product liability, premises liability, professional liability, employment claims, fire losses, property damage, coverage, and alternative dispute resolution. In addition to handling high exposure litigation, he regularly provides his clients with risk assessment, counseling on lawsuit prevention and advice on early case resolution. He is listed on the mediator panels for the Idaho Supreme Court and the United States District Court for Idaho. His practice extends throughout Idaho and into neighboring jurisdictions. He has argued appeals before the Idaho Supreme Court and the Ninth Circuit Court of Appeals.



Mr. Knotts’ current cases relating to the Amusement and Leisure industry include:

  • Defending the operators of an all-terrain vehicle that caused the Trinity forest fire in Boise National Forest, leading to claims by the United States exceeding $50 million dollars. The United States Attorney has allowed the statute of limitations to expire against Mr. Knotts’ clients, opting to pursue the manufacturer only, but the potential remains for an action against the clients for contribution.
  • Defending a trampoline park against an action arising out of a cervical fracture. Alleged damages exceed $1 million. The trial court granted summary judgment based on insufficient evidence of any breach of duty. The action now is on appeal to the Idaho Supreme Court.
  • Defending an action against a campground operator in Sawtooth National Forest based on a tree falling upon the Plaintiff and causing a paralyzing injury to her spine. Alleged damages are in the millions.
  • Defending an action against a northern Idaho resort arising out of a trip and fall on the deck of a floating restaurant, causing closed head and orthopedic injuries.
